Chinese Ministries Check Migrant Workers' Salary Payments

To ensure migrant workers can get their salaries before going home for the 2008 New Year and Spring Festival and consolidate the long-term mechanism for migrant workers' salaries, the Ministry of Labor and Social Security, Ministry of Construction, Ministry of Public Security and All China Federation of Trade Unions have decided to conduct a special check on the payment of migrant workers' salaries.

According to the website of MLSS, MLSS has issued a circular on the special check of the payment of migrant workers' salaries in which it has asked units that employ migrant workers, particularly those from the manufacturing, construction, food and other labor intensive industries that hire the most migrant workers, to be checked. It says these units will be mainly checked on whether they have paid the migrant worker employees according to the state's relevant regulations and whether they have signed labor contracts with the migrant workers.

The check, which lasts from October 19, 2007 to January 31, 2008, will be done in three phases. From October 19 to October 31, it is promotion period; the period between November 1 and November 15 is for the enterprises to carry out self-checks; and the period between November 16 and January 31, 2008 is the enforcement period.

The circular says severe punishment will be given to enterprises that defer or deduct migrant workers' salaries. It says those violators will be fined, exposed to the media or have their business licenses cancelled according to the degree of their violations.
