Chinese Consumer Sues Dumex Over Milk Quality

Believing that Dumex milk powder has a quality problem, a Xi'an consumer surnamed Wang has brought the milk manufacturer to court.
Wang bought eight 1200 gram bags of Dumex infant formula milk powder in March this year. After she opened one bag of the milk powder with the manufacturing date of January 29, 2008 and the series number of 2E8029-0455, she found the milk powder had the odor of chemicals and the other three bags that were in the same batch with the one she had opened had the same problem, while the other four bags from a different batch were good. Wang said Dumex first reached an verbal agreement with her and agreed to compensate her for the four bags with problems. Later it refused to pay the compensation saying that the milk powder proved to be qualified through testing. Since Dumex did not give Wang the test report, she thought Dumex was trying to shirk its responsibilities and that's why she brought the company to court.
Wang asked in her petition that Dumex stop selling the unqualified milk powder, refund her RMB348 goods payment and pay the sum of RMB80,000 in compensation which she claims was originally agreed by Dumex.
The case has been accepted by Xi'an Yangta District Court and it will be heard soon. Dumex said they would actively respond to the lawsuit and would comply with the court's decision.
