China Enacts Rules For Implementing Food Safety Law

Chinese premier Wen Jiabao has approved the Rule on the Implementation of the Food Safety Law of the People's Republic of China.

According to the Rule, food manufacturers will be included on a food safety credit archive when they recall substandard food products. The Rule says that the quality supervision department, the industrial and commercial department, and the food and drug administration departments above county level should register recalls by food manufacturers and operators and the suspension of a particular food product on their food safety credit archives.

The Rule states that food manufacturers should dispose of or destroy their recalled products safely to prevent them from entering into the market again. And food manufacturers can resell food that was recalled for unqualified tags or specifications if they take immediate remedial measures to ensure food safety, but they should declare the remedial measures to consumers when they re-sell the products.

The Rule says that the quality supervision department, industrial and commercial department and food and drug administration department above county level should enhance their daily supervision of food manufacturers and order them to rectify problems immediately if an irregular practice is found.

The Rule states that food manufacturers and operators should be encouraged to use advanced technology to record the Food Safety Law and this Rule; and food service providers should make specifications for raw material outsourcing to ensure it conforms to the food safety standard.
